These Terms of Service ("Terms") govern your access to and use of the Joyful Treasures Media platform, website, mobile applications, and related services (collectively, the "Services") provided by Joyful Treasures Media, LLC ("JTM," "we," "us," or "our").

By creating an account, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Services.

If you use the Services on behalf of a child, you represent that you are the child's parent or legal guardian (or otherwise legally authorized caregiver) and that you accept these Terms on the child's behalf and are responsible for their use of the Services.

 

1. OVERVIEW OF THE SERVICES

Joyful Treasures Media is a family-centered, Real-Life Learning Media platform that allows adult caregivers to:

  • Upload short videos and other content reflecting real-life family moments ("Treasures");
  • Apply gentle editing templates (e.g., trimming, transitions, audio smoothing, calm music) to enhance those videos;
  • Save and organize enhanced videos in a private Treasured Families space; and
  • Optionally share selected Treasures within a community environment called Joyful Village, where other JTM members can view and engage with shared content.

The Services are designed to support the whole child—including emotional growth, curiosity, and early thinking skills—through calm, personalized media created from everyday life.

We may update, modify, or discontinue certain features from time to time.

2. ELIGIBILITY & ACCOUNT REGISTRATION

2.1 Age and Legal Capacity

The Services are intended to be used by adults on behalf of children, not directly by children.

To create an account or otherwise use the Services, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction); and
  • Have the legal capacity to enter into a binding agreement.

Children under 18 are not allowed to create accounts or agree to these Terms. Any access by children must be under the direct supervision and responsibility of a parent, legal guardian, or authorized adult caregiver (“Caregiver”).

2.2 Caregiver Responsibility for Minors

If you use the Services to upload, manage, or share content about a child, or if you allow a child to view or interact with the Services:

  • You represent and warrant that you are the child's parent, legal guardian, or have appropriate legal authority to act on their behalf.
  • You consent to our collection, use, and disclosure of personal information relating to that child as described in our Privacy Policy.
  • You agree to be fully responsible for the child's use of the Services and for all actions taken under your account.

You must not permit unsupervised child access to the Services, and you must monitor and manage your account, settings, and shared content accordingly.

2.3 Account Information

When you create an account, you agree to:

  • Provide true, accurate, and complete information;
  • Keep your login credentials secure and confidential; and
  • Promptly update your account information if it changes.

You are responsible for all activity that occurs under your account, whether or not authorized by you. If you suspect unauthorized use of your account, you agree to notify us promptly at info.help@joyfultreasuresmedia.com.

3. CHILDREN'S PRIVACY & COPPA

We are committed to protecting children's privacy. JTM complies with the Children's Online Privacy Protection Act (COPPA) and other applicable U.S. child privacy laws.

3.1 Parental Consent

We do not knowingly collect personal information from children under 13 without the verifiable consent of a parent or legal guardian. By creating an account and uploading content about a child, you:

  • Represent that you are the child's parent or legal guardian (or that you have appropriate authority); and
  • Provide consent for us to collect, use, and process the child's personal information in connection with the Services.

3.2 Information We Collect

We may collect information about children, such as:

  • First name, nickname, or initials;
  • Age or approximate age range;
  • Images, audio, or video in Treasures;
  • Usage metadata (e.g., which videos are played, how often).

Details are provided in our Privacy Policy.

3.3 Parent Rights

Parents/legal guardians have the right to:

  • Review the personal information we have about their child;
  • Request that we delete that information; and
  • Withdraw consent for further collection or use.

To exercise these rights, contact us at privacy@joyfultreasuresmedia.com. We may need to verify your identity and relationship to the child.

3.4 School or Institutional Use (If Applicable)

If JTM is ever used through a school, childcare program, or similar institution, that institution is responsible for obtaining any required parental consents under COPPA or applicable law. In such cases, our agreements with the institution may govern how child data is handled, in addition to these Terms and our Privacy Policy.

4. USER CONTENT & LICENSE GRANT

4.1 Definition of User Content

"User Content" means any content or materials you upload, submit, or otherwise provide through the Services, including but not limited to:

  • Videos, audio, photos, and images;
  • Text, captions, titles, or notes;
  • Comments or interactions within Joyful Village.

4.2 You Retain Ownership

You retain all rights of ownership that you hold in your User Content. JTM does not claim ownership of your original family moments.

4.3 License You Grant to JTM

To operate, improve, and provide the Services, you grant JTM a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to:

  • Host, store, reproduce, adapt, modify (for example, format, compress, or apply templates),
  • Publicly or privately display and perform (as configured in your settings), and
  • Otherwise use your User Content solely for the purposes of:
  • Providing and maintaining your Treasured Families space;
  • Enabling you to share within Joyful Village or other sharing options you choose;
  • Operating, securing, troubleshooting, and improving the Services; and
  • Creating de-identified or aggregated data and analytics.

We do not use your identifiable User Content for advertising or sell your child’s personal data.

4.4 Public vs. Private Contexts
  • Treasured Families: Your Treasures in Treasured Families are private to your account and any family members you choose to invite, subject to your settings. We will not share these Treasures publicly without your explicit permission, except as required by law or to protect safety.
  • Joyful Village: When you choose to share a Treasure in Joyful Village, it becomes viewable by other JTM members within that community environment. We may use Joyful Village content to moderate, feature, or highlight community engagement within the platform.

You can remove a Treasure from Joyful Village at any time. However, removal does not ensure that other users have not previously viewed, saved, or otherwise recorded the content.

4.5 License Duration

This license to JTM continues:

  • For as long as your User Content is stored on or shared through the Services; and
  • For a reasonable period after deletion to maintain backups, resolve disputes, and comply with legal obligations.

We may retain de-identified or aggregated data derived from your use of the Services indefinitely.

4.6 Your Responsibility for User Content

You represent and warrant that:

  • You own or have all necessary rights and permissions to upload and share your User Content;
  • Your User Content does not infringe or violate any third-party rights, including privacy, publicity, or intellectual property rights; and
  • Your User Content complies with these Terms and all applicable laws.

You are solely responsible for your User Content and the consequences of uploading or sharing it.

4.6 Your Responsibility for User Content

You represent and warrant that:

  • You own or have all necessary rights and permissions to upload and share your User Content;
  • Your User Content does not infringe or violate any third-party rights, including privacy, publicity, or intellectual property rights; and
  • Your User Content complies with these Terms and all applicable laws.

You are solely responsible for your User Content and the consequences of uploading or sharing it.

5. COMMUNITY FEATURES: TREASURED FAMILIES & JOYFUL VILLAGE

5.1 Treasured Families

"Treasured Families" is your private family space within JTM. In this space you can:

  • Upload and enhance Treasures;
  • Organize them for your child's learning and memories; and
  • Share access with trusted family members or caregivers you invite.

You are responsible for managing permissions and who you invite into your Treasured Families environment.

5.2 Joyful Village

"Joyful Village" is a community hub for JTM members. It is not a private space.

When you choose to share a Treasure in Joyful Village:

  • You understand it is visible to other JTM members;
  • You may receive supportive comments or reactions; and
  • JTM may moderate or remove content to maintain a safe, uplifting environment.

We may highlight certain Joyful Village content (for example, as “featured Treasures”) within the platform, but we will not share such content outside JTM’s Services without additional consent.

5.3 Community Guidelines

You agree to follow our Community Guidelines, which are incorporated by reference. In summary, you must:

  • Be kind, respectful, and supportive;
  • Only upload content you have the right to share;
  • Avoid unsafe, explicit, or harmful content; and
  • Respect the privacy and dignity of all children and families.

We may remove any content, suspend or terminate accounts, or take other appropriate measures if we believe a user has violated these guidelines or these Terms.

6. PROHIBITED CONDUCT

You agree not to, and will not permit any child or other person using your account to:

1. Upload or share content that is:

  • Sexually explicit, exploitative, or suggestive involving minors;
  • Violent, harassing, bullying, hateful, or discriminatory;
  • Obscene, excessively graphic, or otherwise inappropriate for a family and child-focused space;
  • Defamatory or unlawfully invasive of another's privacy; or
  • In violation of any law or regulation.

2. Upload or share content that:

  • Infringes any copyright, trademark, or other intellectual property or proprietary right;
  • Includes personal information such as home addresses, precise locations, school names, medical records, or other highly sensitive data;
  • Includes another person's or child's image or voice without their or their legal guardian's permission.

3. Engage in harmful or disruptive activity, including but not limited to:

  • Using the Services for any commercial advertising or solicitation;
  • Sending spam or automated messages;
  • Attempting to access, probe, or breach any security or authentication measures;
  • Introducing viruses, malware, or other harmful code;
  • Scraping, copying, or harvesting data from the Services except as permitted for your personal use.

4. Misuse the Services, including:

  • Reverse-engineering, decompiling, or attempting to derive the source code of the Services;
  • Reselling, renting, or sublicensing access to the Services;
  • Using the Services for any illegal, harmful, or unauthorized purpose.

We reserve the right to investigate and take appropriate action (including removal of content, suspension or termination of accounts, and contacting law enforcement) in response to violations of these Terms or suspected harmful behavior.

7. SUBSCRIPTIONS, BILLING, CANCELLATION, AND REFUNDS

7.1 Plans and Free Trial

JTM may offer different subscription plans and a free trial period.

  • Currently, JTM offers a 30-day free trial and a $7.99/month plan with a defined number of enhanced Treasures (e.g., 5 per month).
  • Plan details, limits, and pricing are described on our website or within the app and may change over time.

We will clearly disclose applicable pricing and plan details at the time of sign-up.

7.2 Recurring Billing

If you sign up for a paid subscription, you authorize JTM (or our payment processor or app store provider) to charge your chosen payment method on a recurring basis (e.g., monthly) for the subscription fees in effect at the time of renewal.

Subscriptions automatically renew at the end of each billing period unless you cancel prior to the renewal date.

7.3 Cancellation

You may cancel your subscription at any time by following the instructions in your account settings or, if purchased via the Apple App Store or Google Play, through your device's subscription settings.

  • Cancellation will take effect at the end of the current billing period.
  • You will continue to have access to paid features until that time.

We do not accept cancellation requests via social media or unverified channels.

7.4 Refunds

Unless otherwise required by law or expressly stated by us:

  • All fees are non-refundable; and
  • We do not provide partial refunds or credits for unused time, downgraded plans, or unused Treasures.

We may, at our sole discretion, offer refunds, credits, or other accommodations on a case-by-case basis. Such decisions do not create an obligation to do so in the future.

7.5 Price Changes

We may change subscription pricing or plan features from time to time. If we increase subscription prices for existing subscribers, we will provide reasonable advance notice (for example, via email or in-app notice). The new price will apply at the start of the next billing period following the notice. If you do not agree to the change, you must cancel your subscription before the renewal.

8. INTELLECTUAL PROPERTY RIGHTS

8.1 JTM Content and Technology

All rights, title, and interest in and to the Services, including:

  • Software, code, interfaces, and infrastructure;
  • Design, layout, graphics, illustrations, and branding;
  • Text, educational frameworks, templates, and other instructional content; and
  • Any aggregated or de-identified data,

Are owned by JTM or its licensors and are protected by copyright, trademark, and other laws.

Except for the limited rights expressly granted to you under these Terms, no licenses or rights are granted to you by implication or otherwise.

8.2 Limited License to You

Subject to your compliance with these Terms, JTM grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to:

  • Access and use the Services; and
  • View JTM's content and your User Content through the Services, solely for your personal, non-commercial, family use.

You may not copy, modify, distribute, sell, or lease any part of the Services or included content beyond what is expressly permitted in these Terms.

9. THIRD-PARTY SERVICES & LINKS

The Services may include links to third-party websites, services, or resources that are not owned or controlled by JTM.

  • We do not endorse or assume responsibility for any third-party content, products, services, or privacy practices.
  • Your use of third-party services is at your own risk and may be subject to separate terms and policies.

10. DMCA & COPYRIGHT COMPLAINTS

JTM respects intellectual property rights. If you believe that any content on the Services infringes your copyright, you may submit a notice in accordance with the Digital Millennium Copyright Act (DMCA) to:

Your notice should include:

  • Your physical or electronic signature;
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the alleged infringing material and information reasonably sufficient to locate it;
  • Your contact information;
  • A statement that you have a good-faith belief that the use is not authorized; and
  • A statement, under penalty of perjury, that the information is accurate and you are the owner or authorized to act on the owner's behalf.

We may remove or disable access to allegedly infringing material and may terminate repeat infringers’ accounts as appropriate.

11. TERMINATION & SUSPENSION

We may, in our sole discretion and without prior notice, suspend or terminate your access to the Services, remove your User Content, or take other appropriate actions if we believe that:

  • You have violated these Terms or our Community Guidelines;
  • You use poses a risk to children, other users, or the platform;
  • We are required to do so by law or regulatory request; or
  • Continued access is no longer commercially or operationally feasible.

You may terminate your account at any time by following the instructions in your account settings or contacting us at info.help@joyfultreasuresmedia.com.

Upon termination:

  • Your right to use the Services will cease;
  • We may delete or anonymize your account data and User Content, subject to legal retention requirements; and
  • Your obligations under provisions that by their nature should survive (including ownership, license grants, disclaimers, limitations of liability, and indemnification) will continue.

12. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT (INCLUDING JTM CONTENT AND USER CONTENT) ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

JTM AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT
  • ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
  • ANY WARRANTY THAT ANY EDUCATIONAL, DEVELOPMENTAL, OR LEARNING RESULTS WILL BE ACHIEVED; AND
  • ANY WARRANTY AS TO THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT.

Any guidance or suggestions provided through the Services are for informational and enrichment purposes only and are not professional educational, medical, or therapeutic advice. You are responsible for using your own judgment in applying any content to your family’s context.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • JTM AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, GOODWILL, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • JTM'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO JTM FOR THE SERVICES IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. In such cases, JTM’s liability shall be limited to the greatest extent permitted by applicable law.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless JTM and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use or misuse of the Services;
  • Your User Content;
  • Any violation of these Terms; or
  • Any violation of another party's rights (including privacy or intellectual property rights) by you or any child using your account.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense.

15. DISPUTE RESOLUTION, ARBITRATION & CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

15.1 Informal Resolution

Before filing any formal claim against JTM, you agree to try to resolve the dispute informally by contacting us at info.help@joyfultreasuresmedia.com with a description of your claim. We will attempt to resolve the dispute informally within 30 days.

15.2 Binding Arbitration

If we are unable to resolve the dispute informally, you and JTM agree to resolve any and all disputes arising out of or relating to these Terms or the Services through binding individual arbitration, instead of in court, except that either party may seek relief in small claims court if eligible.

Arbitration shall be conducted by a recognized arbitration provider (such as the American Arbitration Association) in accordance with its rules. The arbitration will take place in North Carolina, unless we agree otherwise.

15.3 Class Action Waiver

YOU AND JTM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Unless you and JTM agree otherwise, the arbitrator may not consolidate more than one person's claims or preside over any form of a representative or class proceeding.

15.4 Opt-Out

You may opt out of this arbitration and class action waiver provision by sending a written notice to info.help@joyfultreasuresmedia.com within 30 days of first accepting these Terms, stating that you wish to opt out of arbitration. If you opt out, you agree that any disputes will be resolved in the state or federal courts located in Cabarrus County, North Carolina, and you waive any objection to jurisdiction or venue in such courts.

16. GOVERNING LAW

These Terms and any disputes arising out of or related to them or the Services shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles, and applicable federal law.

Subject to the arbitration provisions above, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Cabarrus County, North Carolina, for any non-arbitrable claims.

17. CHANGES TO THE TERMS

We may update or modify these Terms from time to time. When we do, we will update the "Last Updated" date at the top and, where required by law or as appropriate, provide additional notice (e.g., via email or in-app notice).

If you continue using the Services after the revised Terms become effective, you are agreeing to the updated Terms. If you do not agree, you must stop using the Services and may cancel your account.

18. MISCELLANEOUS

  • Entire Agreement. These Terms, together with our Privacy Policy and any other referenced policies or guidelines, constitute the entire agreement between you and JTM regarding the Services.
  • Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
  • No Waiver. Our failure to enforce any provision of these Terms will not waive our right to enforce that provision or any other provision.
  • Assignment. You may not assign or transfer these Terms or your rights or obligations hereunder without our prior written consent. We may assign these Terms without restriction.
  • Headings. Section headings are for convenience only and have no legal or contractual effect.
